What is ICE?
U.S. Immigration and Customs Enforcement enforces federal law governing border control, customs, trade and immigration to promote homeland security and public safety. ICE's mission is to identify, arrest, and remove criminal aliens who present a danger to national security or are a risk to public safety, as well as to those that enter the United States illegally or otherwise undermine the integrity of the immigration laws. The Enforcement and Removal Operations upholds the United States's immigration laws through enforcement and removal operations. The enforcement and removal branch enforces the nation's immigration laws in a fair and effective manner. It identifies and apprehends removable aliens, detains these individuals when necessary and removes illegal aliens from the United States.
Do Immigrants Have Rights?
The answer is yes, regardless of your immigration status. The fact is that all people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution. If ICE agents arrive at one's home these rights can be evoked to protect you and your family.

Increased Collateral Arrests By ICE
The current presidential administration has made it clear that it will target undocumented immigrants in our communities. As a result it is more than likely that many immigrants will be detained and arrested by ICE as a result of "collateral' contact in the community. Inresponse to California's "sanctuary City" policies, ICE has made it clear that it will conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests. ICE will also likely have to detain individuals arrested in California in detention facilities outside of the state, far from any family they may have in California.
What if ICE knocks on my door, do not open the door, instead tell them through the door;
I do not wish to speak with you, answer your questions, or sign or hand you any documents based on my 5th Amendment rights under the United States Constitution.
I do not give you permission to enter my home based on my 4th Amendment rights under the United States Constitution unless you have a warrant to enter, signed by a judge or magistrate with my name on it that you slide under the door.
I do not give you permission to search any of my belongings based on my 4th Amendment rights.

Increase In Work Place Raids
ICE strongly prosecutes employers who knowingly hire illegal immigrant workers, in addition to deporting those workers. ICE has already stepped up workplace enforcement and is predicted to increase four to five times. It has been reported that ICE has taken a stance to increase worksite enforcementwith an increased number of inspections and worksite operations. This aggressive stance by ICE will undoubtedly cause more collateral detentions.
Immigrant Defendants Have a Right To Effective Assistance of Counsel Through Every Stage of Criminal Court
While most claims may seek to invalidate a conviction based on a plea of guilty or no contest, a defendant may vacate a conviction, even after trial, on the ground of ineffective assistance during plea bargaining. A claim of immigration related ineffectiveness may be presented where, through counsel's error during plea bargaining, in failing to advise the defendant of the adverse immigration consequences of a conviction at trial, the defendant fails to defend against these advise immigration consequences by failing to seek an alternative disposition to avoid them.
